PositionsVACANT allows you to access your information at any time to keep it accurate
and up to date. Any information which we hold for you is stored on secure servers
that are protected in controlled facilities.
PositionsVACANT employees and contractors who provide services related to our information
systems are obliged to respect the confidentiality of any personal information held
by us. However, PositionsVACANT accepts no responsibility for events arising from
unauthorised access of your personal information.
Credit & Debit Card Payments
We allow you to purchase services from us by credit card. To ensure absolute security
and privacy, we entrust credit card transactions to eWay, one of the worlds
leading credit card payment solutions providers. Customers may supply credit card
numbers by other means, and the transactions will be handled by eWay. Your
credit card details will not be retained by us following the transaction.
Refunds and Returns
Should you cancel your purchase, we will refund your payment in full. If you paid
by credit or debit card from this web site, your refund will be made directly to
your credit or debit card within 30 days of your cancellation. If you paid by any
other means, your refund will be made by cheque which will be posted to you within
30 days of your cancellation. There will be no charges for cancellation.
There will be no refund for unused Job Ad Credits.
Security for Advertisers
The security of your personal details is our primary concern. To ensure that we
offer you the highest standard available we use the VeriSign Secure Site Program
and Comodo Certificate Authority. Our Servers use Secure Socket Layers (SSL), an
Encryption Technology so that only our authorised personnel can read your personal
information. You will know that you are in a secure environment as an unbroken key
or closed lock symbol will appear at the bottom of the browser window. You should
also see a 's' after the http on the URL address.
We do not retain any of your credit/debit card details within our database; these
details are kept within the eWay secure payment gateway. You can learn more
about eWay at www.eWay.com. We also use eWay to validate your payment
on line before you receive a confirmation order number.
Advertiser Code of Conduct
Employers and Agencies should:-

Avoid any practice or activity that could reasonably be foreseen to bring PositionsVACANT
into disrepute;

Comply with all relevant Australian laws, including privacy, fair trading, trade
practices and anti-discrimination laws;

Avoid asking questions that may breach discrimination legislation such as those
relating to a Job Seekers gender, religion, sexual preference or other information
that is not relevant to the position being advertised;

NOT use applications to gather personal details for other Employment
agency databases; and
- Ensure conditions offered are the same as those stated in the Vacancy. Failure to
do so may be a breach of the Trade Practices Act 1974 and can be referred to the
Australian Competition and Consumer Commission for investigation.
Vacancies entered may be subject to screening. The Vacancy may be checked to ensure
they satisfy these Conditions and are suitable for public viewing. Information that
is considered false, misleading, offensive or unlawful will not be displayed and
will subsequently be removed from the system at the discretion of PositionsVACANT.
The User responsible may be refused future access to this service and the matter
may be referred to the appropriate authority.
It is unlawful to transmit material that is considered offensive or is misleading.
The User responsible will have details passed onto the appropriate authorities.
Display on Third Party Sites
By advertising on PositionsVACANT you expressly consent to your vacancy being advertised
on Internet sites other than PositionsVACANT as well as displayed in Third Party
products/services which are designed to attract job seekers to your ad.
Vacancy Requirements
To the best of their ability, Advertisers should endeavour to ensure that vacancies
they lodge on PositionsVACANT provide the following:

A clear and accurate description of the nature of the work, including details of
the service or product involved;
- Information about remuneration. At a minimum the industrial arrangement must be
stated eg Award, Certified Agreement, Australian workplace agreement, Enterprise
Bargaining Agreement. Where possible it is best practice to provide the name of
the award/industrial arrangement and the indicative salary range or hourly rate.

If income is to be negotiated an indicative salary range or hourly income range
must be stated.

If salary is commission based the rate of commission is to be stated including a
retainer if applicable;
- Government pensions are not acceptable forms of remuneration;
-
Expected vacancies must be flagged as anticipated vacancies and an anticipated start
date must be entered.

Vacancies should state either a set number of hours the employee will work or minimum
hours an employee could expect to work.
You should also
-
lodge vacancies only when there are definite Employment opportunities;

Clearly state if the remuneration for a job is other than wage/salary (eg where
remuneration is by commission);
- Clearly identify Independent Contracting or Sub Contracting business arrangements
in the Vacancy, under Description.
Unacceptable Advertisements
PositionsVACANT reserves the right to classify any Advertisement as unacceptable
for display, including those that could bring PositionsVACANT into disrepute. Examples
of such Advertisements are:

Vacancies which contravene Commonwealth and/or State/Territory legislation (eg.
discriminatory vacancies);

Vacancies which contravene these Conditions or Business Rules;
-
Vacancies which involve activities, products or services which may be considered
offensive, illegal or misleading;

Vacancies involving any form of nudity or work in the sex industry;
-
Training courses;
-
Pyramid selling schemes;
-
Vacancies which do not provide full details of the job, product or service involved;
-
Vacancies which require promotion of gambling or gambling websites;
-
Vacancies where the contractual arrangements are not covered by Australian law;
and
- Vacancies which do not clearly specify any costs to be incurred by the Job Seeker.

PositionsVACANT has a primary goal of matching Employers with qualified staff. Opportunities
for Multi-Level Marketing, Self Employment, Business Opportunities and Commission
Work do not qualify under this objective because the vacancy does not exist as an
Employer/Staff relationship.

Acceptance to this site
PositionsVACANT reserves the right to remove and/or not accept Advertisers at its
discretion and may deny access at its discretion.
